Terms and Conditions for ArtsGarden Website and Services

By accessing this website or purchasing our products, you agree to comply with these terms and conditions in full. If you do not accept any part of these terms, please discontinue use of our website and services.

1. GENERAL TERMS

1.1 Accuracy of Information

All content on this website (including product images, descriptions, specifications, and pricing) is provided for general reference and may be updated without prior notice to reflect changes in product availability, design iterations, or service policies. While we strive for accuracy, minor discrepancies may occur due to the handmade nature of our products (e.g., slight variations in texture, color, or finish for handicrafts) or technical limitations (e.g., screen resolution affecting color representation).

1.2 Prohibited Actions

Unauthorized use of this website—including but not limited to scraping product data, reproducing counterfeit ArtsGarden products, misusing our brand logo/trademarks, or distributing unauthorized copies of our designs—may result in legal action under Indian law (including the Information Technology Act, 2000) and/or claims for damages.

1.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any service or product without prior notice. However, all confirmed and paid orders will be fulfilled as per the original agreement.

2. PRODUCTS AND SERVICES

2.1 Product Range & Availability

ArtsGarden specializes in handmade handicrafts, artist-grade canvases, professional brushes, and high-quality paints. All products displayed on the website are subject to availability. Due to the artisanal nature of our goods, some items may be limited edition or seasonal—we will notify you promptly if an item is out of stock after order placement and offer alternatives (where available) or a full refund.

2.2 Product Variations

We endeavor to ensure product descriptions (e.g., material type for brushes, pigment concentration for paints, canvas grain) are accurate. However:

  • Color Differences: Actual product colors may vary slightly from website images due to screen calibration, lighting during photography, or natural dye variations (for handicrafts).
  • Handmade Variations: Slight differences in size, shape, or finish for handicrafts (e.g., pottery, woodcarvings) are inherent to the craft and not considered defects.
  • Technical Tolerances: Minor deviations in dimensions (e.g., canvas depth) or weight (e.g., paint tubes) may occur due to manufacturing processes, without impacting functionality.
2.3 Pricing & Taxes

Prices listed on the website include applicable Goods and Services Tax (GST) as per Indian regulations. Delivery charges are calculated separately at checkout based on your location (domestic only) and order weight/volume. Free delivery is offered for orders exceeding ₹1,999 (subject to change at our discretion).

3. PAYMENT AND BILLING

3.1 Payment Methods

All payments must be completed at checkout to secure your order. We accept:

  • Debit/Credit Cards (Visa, Mastercard, RuPay)
  • Digital Wallets (Paytm, PhonePe, Google Pay, Amazon Pay)
  • UPI (Unified Payments Interface)

3.2 Billing Accuracy

You are responsible for providing accurate billing details (name, address, contact number, payment information). ArtsGarden is not liable for failed transactions, delays, or delivery errors caused by incorrect/incomplete information.

3.3 Fraud Prevention

Any fraudulent activity or suspected misuse of payment methods will lead to immediate order cancellation, account suspension, and potential legal action under Indian law (Information Technology Act, 2000; Indian Penal Code).

4. SHIPPING AND DELIVERY

4.1 Processing &Dispatch

Orders are processed within 1–2 business days (excluding weekends/public holidays) after successful payment. Once dispatched, a tracking ID will be sent via SMS/email.

4.2 Delivery Timelines

Delivery times vary by location:

  • Metro Cities(Delhi, Mumbai, Bangalore, Chennai): 2–3 business days
  • Tier 2/Tier 3 Cities: 3–5 business days
  • Rural Areas: 5–7 business days
    Delays may occur due to external factors (natural disasters, strikes, logistical disruptions). We will notify you of significant delays.
4.3 Courier Liability

ArtsGarden is not liable for delays, damage, or loss caused by third-party couriers. However, we will assist you in filing a claim if you report:

  • Damage: Within 24 hours of delivery (with photos of the damaged item and packaging).
  • Non-Delivery: Within 3 business days of the expected delivery date.

5. RETURNS AND REFUNDS

5.1 Eligibility Criteria

You may return most ArtsGarden products within 10 days of delivery if:

  • The product is unused, unopened, and in its original packaging(with tags, manuals, and accessories intact—critical for paints, which cannot be resold once opened).
  • The product is defective(e.g., cracked canvas, broken brush bristle, leaking paint tube) or different from the ordered item (wrong size/model/color).
  • Exclusions: Customized items (engraved brushes, personalized canvases) are non-returnable unless defective.
5.2 Return Process
  1. Initiate a return request via our website or email (support@artsgarden.in) with your order ID and reason.
  2. Our team will verify the request and provide a return shipping label (free of charge if the return is due to our error—defect, wrong item, or inaccurate description).
  3. After receiving the returned item, we will inspect it within 3 business days. If approved, your refund will be issued to the original payment method within 5–7 business days(processing times may vary by bank/wallet).
5.3 Shipping Charges

Shipping fees are non-refundable unless the return is due to our error (defect, wrong item, or inaccurate product information).

6. LIMITATION OF LIABILITY

6.1 Indirect Damages

ArtsGarden shall not be liable for indirect, incidental, or consequential damages resulting from product use, including:

  • Loss of artwork due to defective materials (we recommend testing products on a small area before full use).
  • Allergic reactions from paint fumes (all products meet Indian safety standards; follow usage instructions).
  • Loss of business/productivity due to delivery delays or product defects.
6.2 Direct Damages

Our liability for direct damages (e.g., replacing a defective canvas) is limited to the maximum amount paid for the specific product and is subject to Indian law.

7. GOVERNING LAW & JURISDICTION

These terms are governed by the laws of the Republic of India. Any disputes arising from these terms (including product quality, refunds, or service issues) shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka (our headquarters).
